TERMS OF SERVICE

ProofLog Terms of Service

1. Acceptance of Terms

By creating an account, accessing, or using ProofLog ("Service"), you agree to be bound by these Terms of Service ("Terms").

If you do not agree to these Terms, you must not access or use the Service.

These Terms apply to all users, visitors, customers, account owners, employees, contractors, technicians, and any other persons accessing the Service.

2. Description of Service

ProofLog is a cloud-based software platform that enables users to manage equipment records, service histories, maintenance documentation, QR-based asset identification, service requests, reminders, optional location verification, checklists, and related operational information.

The Service is intended to assist users in organizing, storing, and accessing information related to assets, equipment, maintenance activities, inspections, and service interventions.

ProofLog does not perform maintenance services and does not act as a maintenance provider, inspection authority, certification body, or legal verification service.

3. Eligibility

You must be at least 18 years old and legally capable of entering into binding agreements to use the Service.

By using ProofLog, you represent and warrant that you meet these requirements.

4. User Accounts

Users are responsible for maintaining the confidentiality of their account credentials.

Users are responsible for all activities performed under their accounts.

You agree to immediately notify ProofLog of any unauthorized use of your account or any security breach.

ProofLog is not responsible for losses resulting from unauthorized account access caused by weak passwords, credential sharing, phishing, or user negligence.

5. Ownership of Data

Users retain ownership of all content uploaded, created, stored, or managed through the Service, including but not limited to:

service records;
maintenance records;
documents;
photographs;
videos;
audio files;
notes;
checklists;
asset information;
QR-related records.

ProofLog does not claim ownership of user content.

Users are solely responsible for ensuring that they have the legal right to upload and store such content.

6. User Responsibilities

Users agree to use the Service lawfully and responsibly.

Users must not:

upload unlawful content;
upload content connected to criminal activity;
upload fraudulent information;
impersonate another person or entity;
upload malicious software, malware, viruses, or harmful code;
violate intellectual property rights;
interfere with the operation of the Service;
attempt unauthorized access to accounts, systems, or data;
use the Service for harassment, abuse, or illegal purposes.

Users remain solely responsible for all content, records, documents, and information submitted through their accounts.

7. Prohibited Content

The following content is strictly prohibited:

illegal content;
terrorist content;
hate speech;
content promoting violence;
child exploitation material;
pornography or explicit adult content;
content related to illegal drugs or criminal enterprises;
malware or harmful software.

ProofLog reserves the right to:

remove prohibited content;
restrict account access;
suspend accounts;
permanently terminate accounts;
report unlawful activity to competent authorities where required by law.
8. Service Records and Verification

ProofLog provides tools intended to assist users with documentation and record keeping.

ProofLog does not independently verify whether:

a service was actually performed;
an inspection was actually completed;
maintenance work actually occurred;
a technician was physically present at a location.

Service records are created based on information supplied by users and their devices.

ProofLog cannot guarantee the authenticity, accuracy, completeness, or truthfulness of user-submitted information.

9. Location Verification Disclaimer

Location verification features are provided solely as informational tools.

Location information may be affected by:

GPS inaccuracies;
device limitations;
browser restrictions;
network conditions;
environmental factors;
user manipulation.

ProofLog does not guarantee actual physical presence at any location.

Any location-related information should be interpreted as supporting information only.

10. Accuracy Disclaimer

Users acknowledge that information stored within the Service may originate from:

users;
mobile devices;
browsers;
operating systems;
cameras;
GPS providers;
third-party services.

Such information may be inaccurate, incomplete, delayed, modified, or falsified.

The only information generated directly by ProofLog systems consists of:

server-generated timestamps;
system logs;
platform-generated identifiers.

ProofLog makes no warranties regarding the accuracy of user-supplied information.

11. Client Signatures

The Service may allow users to collect digital signatures.

ProofLog does not independently verify the identity of any signatory.

Users are solely responsible for obtaining valid signatures and ensuring that the individual providing a signature is authorized to do so.

ProofLog does not guarantee the legal enforceability of any signature collected through the Service.

12. Payments

ProofLog uses third-party payment providers, including PayPal.

Payment information is processed directly by such providers.

ProofLog does not store:

credit card numbers;
debit card numbers;
banking credentials;
payment authentication information.

ProofLog may store limited billing information including:

payment confirmations;
transaction identifiers;
subscription status;
billing history.

Users agree to comply with the terms and conditions of the applicable payment provider.

13. Subscription Plans

ProofLog may offer free and paid subscription plans.

Features, limits, and pricing may vary depending on the selected plan.

Subscription details are governed by the separate Subscription Terms.

ProofLog reserves the right to modify pricing, features, or subscription plans in the future.

Reasonable notice will be provided where required by applicable law.

14. Subscription Expiration

If a subscription expires, is canceled, or becomes inactive:

account data may remain stored;
existing records may remain accessible;
editing functionality may be restricted;
creation of new assets or records may be restricted;
account access may be limited according to subscription status.

ProofLog may archive inactive accounts.

Archived accounts may remain available for future reactivation.

15. QR Codes and Asset Continuity

Users understand that QR codes may remain operational after subscription expiration in order to preserve:

historical service records;
asset continuity;
documentation access;
previously recorded information.

ProofLog reserves the right to maintain limited access to historical information associated with QR codes.

16. Reporting Abuse

ProofLog reserves the right to investigate reports concerning:

fraud;
abuse of the Service;
criminal activity;
unauthorized access;
prohibited content;
security threats.

ProofLog may temporarily restrict access to accounts during investigations.

17. Cooperation With Authorities

Where required by applicable law, valid legal process, court order, or competent governmental authority, ProofLog may disclose relevant information.

ProofLog will not voluntarily disclose user information without a lawful basis.

18. Intellectual Property

The ProofLog platform, software, branding, logos, designs, source code, documentation, and related materials remain the exclusive property of ProofLog and its licensors.

Users may not:

copy;
reverse engineer;
modify;
distribute;
resell;
sublicense;
exploit

the Service without prior written permission.

19. Service Availability

ProofLog aims to provide reliable service but does not guarantee uninterrupted availability.

Temporary interruptions may occur due to:

maintenance;
software updates;
infrastructure failures;
force majeure;
internet outages;
third-party service disruptions.

ProofLog shall not be liable for temporary service interruptions.

20. Data Retention and Backups

ProofLog may perform backups for operational and security purposes.

Users remain responsible for maintaining copies of critical records and documents.

ProofLog does not guarantee recovery of all data in all circumstances.

21. Limitation of Liability

To the maximum extent permitted by law, ProofLog shall not be liable for:

loss of profits;
loss of revenue;
loss of business opportunities;
business interruption;
loss of goodwill;
inaccurate user-provided information;
decisions made based on records stored within the Service;
indirect, incidental, consequential, special, or punitive damages.

The Service is provided on an "AS IS" and "AS AVAILABLE" basis.

Users use the Service at their own risk.

22. Maximum Liability

To the maximum extent permitted by law, the total liability of ProofLog arising from or related to the Service shall not exceed the total amount paid by the customer to ProofLog during the twelve (12) months preceding the event giving rise to the claim.

23. Termination

ProofLog may suspend or terminate accounts that:

violate these Terms;
engage in unlawful activity;
abuse the Service;
threaten platform security;
repeatedly violate platform policies.

Termination does not automatically result in deletion of data where retention is necessary for operational, legal, security, or historical reasons.

24. Changes to Terms

ProofLog may update these Terms from time to time.

Updated versions will be published on the Service.

Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

25. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the Republic of Serbia, without regard to conflict of law principles.

Any disputes arising from these Terms shall be subject to the jurisdiction of the competent courts of the Republic of Serbia.
